Terms of Service - Crux Interactive

1. Acceptance of these Terms

By accessing or using Crux Interactive services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the services.

Some features may include additional rules, prompts, plan limits, app-store terms, community guidelines, developer documentation, or purchase terms. Those additional terms apply to the features they describe.

If you use the services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts and eligibility

You may need a Crux ID to access account, AI, social, cloud, game, or developer features. You are responsible for keeping your login credentials, sessions, devices, and API keys secure.

You must provide accurate account information and keep it current.
You may not share, sell, rent, transfer, or misuse another user's account.
You are responsible for activity under your account unless the activity results from our failure to use reasonable security measures.
You should enable two-factor authentication where available and tell us promptly if you believe your account was compromised.
If you are under the age required by law to use an online service independently, you may use the services only with permission from a parent or guardian.

3. Rules of use

You agree not to misuse the services or help anyone else misuse them. Prohibited conduct includes:

Violating law, infringing rights, impersonating others, or misrepresenting your identity or affiliation.
Harassing, threatening, abusing, exploiting, doxxing, or targeting other users.
Uploading malware, attempting unauthorized access, bypassing rate limits or access controls, scraping at abusive scale, or disrupting the services.
Using the services to create, distribute, or request illegal, harmful, exploitative, deceptive, or rights-infringing content.
Reverse engineering, copying, reselling, or using Crux Interactive software, models, APIs, or content except as allowed by law or by written permission.
Using CruxAI or the developer API to make automated high-impact decisions about people without appropriate human review, notice, consent, and legal basis.

4. Your content and permissions

You keep ownership of content you submit, upload, create, or store through the services, subject to rights owned by others. You grant Crux Interactive a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, modify for technical formatting, and otherwise use your content as needed to operate, secure, improve, and provide the services.

You are responsible for your content and must have the rights needed to upload or share it. Do not upload private, confidential, copyrighted, or sensitive information unless you have the right to do so and are comfortable with the way the selected feature works.

Public posts, comments, profiles, guild activity, shared cloud links, public game stats, and similar features may be visible to other users or link recipients depending on your settings.

5. CruxAI and AI outputs

CruxAI features can generate text, images, code, summaries, search-grounded answers, speech, and other outputs. AI outputs may be inaccurate, incomplete, offensive, or unsuitable for your use case. You are responsible for reviewing outputs before relying on, publishing, or using them.

AI outputs are not professional legal, medical, financial, safety, or mental-health advice.
Generated content may resemble existing content or outputs generated for other users.
You may not use CruxAI to violate law, infringe rights, deceive people, generate harmful instructions, evade safety systems, or create abusive content.
When you upload files, images, photos, camera frames, voice input, or location context, you authorize us and relevant providers to process that material to provide the requested AI feature.
If you enable memory, auto-learn, connectors, web search, sandbox tools, or developer data sharing, you are responsible for the information you make available through those features.

6. Crux Cloud, Connect, and community features

Crux Cloud is intended for files you are allowed to store and share. You are responsible for backing up important files. We may enforce file-size, quota, file-type, security, and sharing limits to protect the platform.

Connect and other community services may include posts, comments, direct messages, reactions, guilds, reports, friends, blocks, status messages, Discord linking, public game stats, and similar social features. We may remove content, limit distribution, disable sharing links, restrict messaging, or suspend accounts when we believe content or conduct violates these Terms, feature rules, law, or user safety.

Reports, moderation records, security logs, and abuse-prevention information may be kept even if the related public content is removed.

7. Developer API and integrations

If you use CruxAI APIs, API keys, workspaces, credits, or developer tools, you agree to follow the developer documentation, rate limits, model limits, safety requirements, and usage policies shown in the developer portal or API responses.

API keys are secret credentials. You are responsible for securing them and for all usage charged to them until they are revoked or disabled.
You may not resell or expose the APIs as a competing model service without written permission.
You must provide appropriate notices and obtain required rights or consent before sending end-user data, personal data, images, or files to the APIs.
We may throttle, suspend, revoke keys, or block requests that create security, abuse, billing, policy, or reliability risks.
Prepaid credits, free-token allotments, caching, pricing, model availability, and limits may change as the service evolves.

8. Purchases, credits, and subscriptions

Paid features may include subscriptions, prepaid credits, API usage, image generation, storage, games, virtual items, or other purchases. Prices, taxes, limits, renewal terms, and cancellation options are shown where you buy or manage the feature.

Payments may be processed by Stripe, Apple, or another payment provider, and their terms may also apply.
Unless stated otherwise or required by law, purchases are final and non-refundable once delivered, consumed, or applied to your account.
Subscriptions renew automatically unless canceled before the renewal date through the applicable account, billing, or app-store controls.
Credits and virtual items have no cash value, are not bank accounts or stored-value accounts, and may be limited to the service where they were issued.
We may correct pricing, billing, credit, or usage errors and may suspend paid access for failed payments, chargebacks, fraud, or abuse.

9. Third-party services

The services may connect to or rely on third-party platforms, including Google, Apple, Discord, app stores, payment processors, AI providers, web search providers, email providers, hosting providers, and public APIs such as weather or mapping services. We are not responsible for third-party services, content, outages, policies, or fees.

When you authorize a connector or OAuth flow, you are also agreeing to the applicable third-party terms for that service.

10. Changes, suspension, and termination

We may update, add, remove, suspend, or discontinue services or features at any time. We may also update these Terms. If changes are material, we may provide notice through the service, by email, or by updating the effective date.

You may stop using the services at any time and may request account deletion through account tools or by contacting us. We may suspend or terminate access if we believe you violated these Terms, created risk for users or the platform, failed to pay, or used the services unlawfully.

Sections that by their nature should survive termination will survive, including ownership, licenses needed to operate or protect the services, payment obligations, disclaimers, limitations of liability, indemnity, and dispute provisions.

11. Disclaimers and limitation of liability

The services are provided "as is" and "as available." To the fullest extent allowed by law, Crux Interactive disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, security, and uninterrupted operation.

To the fullest extent allowed by law, Crux Interactive will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost content, business interruption, or substitute services. Our total liability for claims related to the services will not exceed the greater of the amount you paid to Crux Interactive for the affected service in the three months before the claim or 100 USD.

Some places do not allow certain disclaimers or liability limits. In those places, the limits apply only to the maximum extent permitted by law.

Indemnity

You agree to defend, indemnify, and hold harmless Crux Interactive from claims, losses, damages, liabilities, costs, and expenses arising from your content, your use of the services, your violation of these Terms, or your violation of law or third-party rights.

These Terms are governed by laws applicable to Crux Interactive in the United States, without regard to conflict-of-law rules, unless mandatory law gives you additional rights.
